IFLR 1000 (International Financial Law Review) 2009

Mr. Oleksandr Mamunya addresses Practice of Trademark Cases Hearing at the Fourth Professional Conference on Intellectual Property Protection: Practice in Alcohol, Tobacco and Food Industries

The Fourth Annual Conference on Intellectual Property Protection: Practice in Alcohol, Tobacco and Food Industries was held in Kyiv on June 12, 2009.

The event attracted more than 50 participants representing the Intellectual Property Department of the Ukrainian Ministry of Education and Science, Antimonopoly Committee of Ukraine, State Customs Service, legal experts, lawyers and attorneys specialized in protection of intellectual property, and alcohol, tobacco and food industries.

The conference addressed the legal protection of intellectual property objects in sphere of production of alcohol, tobacco, and confectionary production; features of the legal protection of volume trade marks and industrial samples; protection of the intellectual property objects’ rights in case of their illegal use and protection against unfair competition; the order of protection of intellectual property rights in Antimonopoly Committee of Ukraine; strategy of intellectual property rights management at the enterprises.

Mr. Oleksandr Mamunya, senior associate with Vasil Kisil & Partners, spoke on “Legal Protection of Intellectual Property Rights: Practice of Trademark Cases Hearing”, touching upon the core judicial protection elements and the most wide-spread legal remedies available for protecting intellectual property rights to trademarks.

“Intellectual properties in general are corporate intangible assets which are practically impossible to hide and in case of trademarks, trying to conceal them simply would not be wise. Now that the intellectual property infringements are common in Ukraine, in particular, in the alcohol, tobacco and food industries, effective protection of such rights becomes an extremely urgent issue. Moreover, it should be noted that one can protect its intellectual property rights by taking action of legal nature only, rather than actual action. Such properties may be of any value only if effective legal protection is available for them,” underlined Mr. Oleksandr in his report.
