Vasil Kisil & Partners Law Firm advised the leading Ukrainian exporter of vegetables on the proper preperation of supporting documentation for the delivered goods, the amount of which does not conform to those specified in the export documentation in order to prevent the risk of penalties for violation of currency legislation of Ukraine, as well as on the legal regulation of penalty under the laws of Ukraine, namely: (1) the possibility of establishing a contractual penalty provided for the supply of products deficient in quality, (2) the possibility of a voluntary payment of contractual penalty without court ruling, (3) of the proper paperwork in order to avoid penalties for violation of Ukrainian currency legislation. In addition, the project also included the appropriate structuring of foreign transactions in terms of the Ukrainian legislation.
