Client: Ukrainian Danube Shipping Company

Representing a Ukrainian Danube Shipping Company OJSC in arbitration before the Maritime Arbitration Commission at the Ukrainian Chamber of Commerce and Industry to recover the debt for vessels' freight from a Cypriot company under the Bareboat Charter Party, compensation of the additional expenses related to the vessels operation, annual interests for non-performance of monetary obligations, and in respect of the Charterer’s counterclaim for compensation of various costs and expenses, including vessel repair expenses. The arbitration also involved the matters of withdrawal of the vessels from freight by the Owners and early termination of the Bareboat Charter Party in connection with the Charterer’s debt, an off-hire application to a bareboat charter, legality of compensation for the Charterer’s costs and expenses in the case of gross violation of the Charter Party by the Charterer, and peculiarities of customs clearance of sea vessels, etc. The total amount in dispute was USD 1.6 million.
