VKP expert speaks on Intellectual Property and Exclusive Data at the Ukrainian Pharmaceutical Forum

On November 10-11, 2009, Adam Smith held the 2nd Annual Ukrainian Pharmaceutical Forum in Kyiv.
The event brought together representatives of state regulatory authorities, leading pharmaceutical manufacturers, distributors, networks and institutions, law firms, analytical and consulting companies, all of which stressed the extreme urgency of the event in connection with recent legislative initiatives of the government in the pharmaceutical industry.
Over one hundred delegates of the Forum analyzed and discussed the most important issues and challenges faced by the sector, including: legislative reforms and governmental initiatives having the decisive influence on the Ukrainian pharmaceutical market; opportunities for productive collaboration between government and business in the adoption of laws; forecasts of possible sector development amidst the financial and consumer market instability for the years immediately ahead; investment potential of various segments of the Ukrainian pharmaceutical market; intellectual property and unfair competition. For obvious reasons, a lot of consideration was given to problems of pharmaceutical network distribution and development.
During the opening of a special expert session on legal matters of the Ukrainian pharmaceutical market, Mr. Oleksiy Filatov, Partner and Head of the Intellectual Property Practice of Vasil Kisil & Partners Law Firm, highlighted the importance of legal regulation of the domestic pharmaceutical market, including problems of intellectual property protection, matters related to the introduction of new medicines onto the market, unfair advertising, clinical trials, and state registration of pharmaceuticals.
Mr. Oleksandr Mamunya, a Senior Associate with Vasil Kisil & Partners, delivered a speech on intellectual property and exclusive data as competitive advantages in the pharmaceutical industry. Mr. Mamunya, in particular, told about legal powers of the owners of intellectual property rights and exclusive data on the pharmaceutical market of Ukraine. He also addressed legal mechanisms for their protection, making a special emphasis on legal remedies. "Against the background of the financial and economic instability when violators of intellectual property rights are extremely active, the lawful owners of such rights are likely to become unconscious ‘donors’ for the decaying business of their competitors. An efficient intellectual property protection is required for strengthening the competitive advantages on the market," noted Mr. Mamunya in his speech.
