Press-conference “New Opportunities of Joint Investment Institutions for the Real Economy”

“New Opportunities of Joint Investment Institutions for the Real Economy”

As of February 10, 2009, when the Law of Ukraine “On Amending the Law of Ukraine “On Joint Investment Institutions (Mutual and Corporate Funds)” came in effect stock market players and business operators are granted new opportunities to use JIIs capabilities to optimize domestic business operations, to enhance tax planning and business structuring. This new law may be qualified as an antirecession instrument for the stock market and the real economy. Due to this very law, conditions for joining funds in order to avoid their liquidation were brought into being, a list of transactions, which asset management companies may enter into, was significantly extended, individuals became entitled to participate in venture funds, and quantitative restrictions on properties to be acquired as assets of the fund were lifted, etc. Said novelties are helpful to promote business activities, reduce tax burden of business operators, and attract foreign investors, etc.
However, the lack of subordinate legislation restrains actual implementation of this law. Moreover, with the Law of Ukraine “On Joint Stock Companies” coming into effect, there is a conflict of law as related to the status of a corporate investment fund impeding further incorporation of corporate investment funds as open (public) joint stock companies and constricting market opportunities. The press conference participants will review the current rule-making situation of the Securities and Stock Market State Commission and explain how new law norms are applied in practice.
