Vasil Kisil & Partners Law Firm acted as a legal counsel and principal drafter of the Law of Ukraine “On Concessions to Construction and Operation of Roads” as adopted by the Verkhovna Rada (Parliament) of Ukraine on January 15, 2009 and effective from January 31, 2009.
The Law expands significantly scopes of concession implementation and includes reconstruction, repair and operation of motor roads. The Law also introduces potential application of new financial instruments in relationships between a concedent and concessioner by using, inter alia, a mechanism of operational availability, issuance of infrastructural bonds, derivative securities and making profits by creating and operating road facilities.
