Intellectual Property Protection: Practice in Alcohol, Tobacco and Food Industries

The conference on Intellectual Property Protection: Practice in Alcohol, Tobacco and Food Industries was held in Kyiv on June 11, 2010. Mr. Oleksandr Mamunya, senior associate of Vasil Kisil & Partners’ Intellectual Property Practice, spoke at and moderated one of its sessions.

The event yet again gathered representatives of large alcohol, tobacco and food producers and distributors, which demonstrates a keen interest in intellectual property issues and their particular relevance to the above industries. Ukraine’s leading competent legal experts specializing in intellectual property protection, as well as participants representing the State Intellectual Property Department, customs authorities, top Ukrainian and international law and auditing firms, and manufacturing companies delivered their presentations at the conference.

Conference attendees discussed the following:
 
  • Legal protection of intellectual properties in producing alcohol, tobacco and confectionary goods;
     
  • Judicial remedy;
     
  • Legal expertise of trade names used in alcohol, tobacco and food industries;
     
  • Strategy and economy of IP rights corporate management.

 
In his presentation, Mr. Oleksandr Mamunya having solid expertise in consulting alcohol, tobacco and food companies on IP-related issues covered in detail various aspects of intellectual properties’ legal due diligence and highlighted key advantages thereof:
 
  • This instrument allows to increase the return of funds as a result of investing in intellectual properties;
     
  • A legal due diligence of trade marks for goods and services is usually a part of a wider integrated due diligence ordered by a company acquiring assets of another company. Such due diligence may result in either a transaction conclusion or its cancellation;
     
  • Such due diligence provides for the identification of new brands and the maximum usage of those available.
     
Oleksandr drew its audience’s attention to the fact that “a regular legal due diligence of intellectual properties may supplement advantages gained by companies using intellectual property rights, as well as strengthen the protection of such properties.”
